Easement and Right of Way Dedication

The Fulton County Land Division works directly with the Department of Environment and Community Development to ensure the required dedications of right-of-way and other easements are completed accurately and efficiently. As these dedications are legal documents and require approval by the Fulton County Board of Commissioners, it is imperative that our procedures are followed as presented.

Right-of-Way and Easement Dedications may only be recorded by a representative of the Land Division.
PLEASE do not attempt to record these documents on your own.

Prior to completing the dedication documents, the following files (in Adobe Acrobat) should be reviewed by the petitioner. We recommend printing out copies of each for reference.

Directions and Document Checklist - this document provides the step-by-step procedures to dedicate right-of-way and easements to Fulton County . Please make sure to complete all of the items on the checklist and make sure to follow the requirements for completing plats.

Requirements for Conveying Title to Land - this document explains a few additional items of documentation that will need to be provided with the dedication. It also includes signature requirements for various ownership entities. NOTE: Please be sure to follow the signature guidelines as there are different requirements for different ownership entities. For instance, a corporation conveyance requires at least two officer signatures OR at least one officer signature and a corporate seal (we prefer two officer signatures AND a corporate seal).

All dedications also require execution of an Owner's Affidavit. There are two versions of the affidavit. The "Individual" version is for those properties owned by an individual or multiple individuals. The "Corporate" version is for those properties owned by corporation, LLC, partnership, etc.

The documents below are the right-of-way and easement forms for the various types of dedications. The documents should be completed in their entirety, executed by the individual/entity in which title is vested ( exactly as shown on the deed of record), and subsequently witnessed and notarized. As with the owner's affidavit, each type of dedication document has an "Individual" version and a "Corporate" version.

* These forms are used when an existing sewer easement
